1. General
The gift certificate purchase contract will be concluded between the buyer and AISAWAN Boutique Spa GmbH. Divergent arrangements will only be valid and legally binding if explicitly agreed in writing. You must be of legal minimum age of 18 years to be entitled to shop on this website.
2. Conclusion of Contract, Payment and Delivery
The gift certificates on AISAWAN Boutique Spa's website constitutre non-binding offers without commitment. Prices quoted include VAT according to legal stipulations. Your online ordering of a gift certificate via internet represent a legally binding purchase offer, entitling AISAWAN Boutique Spa GmbH to accept within 48 hours by order confirmation via email, thereby concluding the purchase contract. In case no order confirmation is being sent within these 48 hours, your purchase offer is deemed to be declined and no purchase contract is being conclude. Upon receipt of payment based on the purchase contract concluded, the gift certificates purchased will be delivered as pdf file (if not agreed otherwise) and printed by the purchasing customer. Upon instruction of the purchasing customer gift certificates may be delivered by postal mail against prepayment by online money transfer ("Sofortüberweisung"). AISAWAN Boutique Spa does not resume any responsibility for a possible delay in the delivery of a gift certificate. In case delivery of an ordered gift certificate should be effected before receipt of the corresponding payment at AISAWAN Boutique Spa GmbH, this gift certificate will not be valid and active until receipt of full payment and AISAWAN Boutique Spa GmbH shall be entitled to retain the right not to honor this gift certificate upon presentation.
3. Gift Certificate
All our gift certificates come with an anti-counterfeit code when being delivered to the purchasing customer. As online gift certificates can be printed countless times, only one print will be honored by AISAWAN Boutique Spa GmbH. Presenting additional prints of the same gift certificate carrying the same anti-counterfeit code for redemption shall be considered fraud with all consequences under criminal law. AISAWAN Boutique Spa GmbH cannot resume any responsibility for verifying the right of possession of a gift certificate presented as they are usually handed over or given away by the purchasing customer. Upon presentation of a gift certificate for redemption, AISAWAN Boutique Spa GmbH just verifies the authenticity of the anti-counterfeit code and the receipt of payment. There is no title or claim for lost gift certificates. The gift certificates are non-redeemable. In case the value of the gift certificate should exceed the price of the treatment consumed, a new gift certificate bearing the remaining value will be generated and issued (non-redeemable). AISAWAN Boutique Spa GmbH is not obliged, however, to accept and redeem gift certificates not paid when being presented. Treatments and services under a valid and paid gift certificate can only be performed and guaranteed upon prior reservation and appointment and may slightly vary from the description stated on the gift certificate, provided that the presenting customer will not suffer a significant diminution in value. In case AISAWAN Boutique Spa GmbH should close or become insolvent, all gift certificates being sold online shall be considered null and void, unless a mere change in ownership should take place. In such case, however, there shall be no claim or title whatsoever against the previous/original owner of AISAWAN Boutique Spa GmbH. All priced of the gift certificates include VAT according to local Austrian law which shall be paid upon performance of the service stipulated under the gift certificate.
4. Validity / Duration of Valididy
All gift certificates are redeemable against prior arrangement of an appointment with AISAWAN Boutique Spa GmbH until the validity date given on the gift certificate. Every gift certificate can be redeemed only once which is secured by the anti-counterfeit code on the gift certificates.
5. Redemption, Invoicing
All gift certificates are non-redeemable. Issuance of a VAT conform invoice can be done only at presentation of the gift certificate for consumption of the service.
6. Data Protection
Protection of your personal data enjoy highest priority! Your personal data (BIC, IBAN, name, address) are being transmitted only via certified payment solution providers via their SSL-protected lines according to PCI rules. Your data will be automatedly processed by us. Based on these GTC a purchasing customer declares his consent to receive advertisements from AISAWAN Boutique Spa GmbH. A transmission of your data to third parties will not take place.
7. Replacement, Right of Withdrawal
Gift certificates which to not correlate with your picture shall be returned to AISAWAN Boutique Spa within 14 days upon receipt. It is mandatory to receive a customer's declaration of withdrawal within 14 days. This right of withdrawal shall be null and void in case the service or treatment under the gift certificate in question has been consumed before the end of the withdrawal period. In case of loss, theft or debasement of gift certificates no compensation can be given by AISAWAN Boutique Spa GmbH.
8. Place of Jurisdiction
All contractual relationships shall be governed by Austrian law. Place of jurisdiction is Vienna, Austria.
